SHORT-TERM RENTAL AGREEMENT

This Rental Agreement (“Agreement”) applies to the individual making the booking

(“Guest”) and all members of the Guest’s party, regardless of age or affiliation

(“Group”). Guest is responsible for ensuring that all members of the Group and any

permitted visitors comply with the terms of this Agreement. In consideration of the rent

received, Owner agrees to rent the Property to Guest subject to the following terms and

conditions:

1. USE OF PROPERTY

Guest agrees to comply with all rules and regulations contained herein and any

additional rules posted at the Property.

Guest shall:

Maintain the Property in a clean, safe, and sanitary condition

Not use the Property for any illegal or commercial purpose

Not create unsafe, nuisance, or unsanitary conditions

Any breach of this clause constitutes a material breach and may result in immediate

termination without refund.

2. OCCUPANCY, ACCESS & USE

Occupancy shall not exceed the number stated in the booking confirmation unless

approved in writing by Owner.

No parties, events, or large gatherings unless pre-approved in writing

No subletting or assignment permitted

Guest is responsible for all visitors

Owner or Owner’s agents may enter the Property upon reasonable notice for inspection,

maintenance, or repair, or immediately in the event of an emergency or suspected

violation.

3. COMPLIANCE WITH LAWS

Guest agrees to comply with all applicable local, county, and state laws, including but

not limited to noise, parking, occupancy, and nuisance regulations.

4. CANCELLATION POLICY

Cancellation terms are governed by the booking platform. Travel insurance, damage

protection, and administrative fees are non-refundable unless required by law.

5. SECURITY DEPOSIT / DAMAGE WAIVER

Guest is required to provide either:

A refundable security deposit, or

A non-refundable damage waiver

If a security deposit is used:

It will be released if no damage is found beyond normal wear and tear

Owner may charge for damages, missing items, excess cleaning, or rule violations

Guest authorizes Owner to charge the payment method on file for any amounts due

under this Agreement. If damages exceed the deposit, Guest agrees to pay the balance

within 5 business days.

6. PET POLICY

Pets are not permitted unless approved in writing. Unauthorized pets may result in

immediate termination without refund and additional cleaning charges may be

incurred.

7. AGE & BOOKING REQUIREMENTS

Guest must be at least 25 years of age and must occupy the Property for the duration of

the stay.

Guest agrees to provide accurate information regarding all occupants, including minors.

8. AMENITIES & OUTAGES

Owner does not guarantee uninterrupted use of utilities or amenities (including but not

limited to internet, appliances, pools, hot tubs, or HVAC systems). No refunds shall be

provided for outages or temporary issues beyond Owner’s control unless required by

law.

9. LOST & FOUND

Guest is responsible for shipping costs for any returned items. Items unclaimed after 30

days may be disposed of at Owner’s discretion.

10. POOL / HOT TUB / EQUIPMENT USE

If provided, all recreational facilities are used at Guest’s own risk.

No glass near pool or hot tub

No pets in pool or hot tub

Children must be supervised at all times

Misuse may result in additional charges.

11. LINENS & PROPERTY CONTENTS

Guest is responsible for any lost or damaged items, including linens and towels, and

may be charged for replacement or repair.

12. LIABILITY

Guest acknowledges that use of the Property and any associated equipment or

amenities involves inherent risks.

Owner shall not be liable for injury, loss, or damage except where caused by Owner’s

gross negligence or willful misconduct.

Guest agrees to indemnify and hold harmless Owner from any claims arising from

Guest’s use of the Property.

13. TERMINATION

Owner may terminate this Agreement for any breach.Guest agrees to vacate immediately upon notice. Failure to vacate may result in

removal and additional charges.

14. CHARGEBACKS

Guest agrees not to initiate any credit card chargeback without first contacting Owner to

resolve the issue.

Unauthorized chargebacks may result in additional fees and legal action.

15. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Texas.

Any legal action shall be brought in the county where the Property is located.

If any provision is deemed unenforceable, the remainder shall remain in effect.
